PENYELESAIAN PEMUTUSAN HUBUNGAN KERJA (PHK) DI LUAR PENGADILAN HUBUNGAN INDUSTRIAL
Abstract
Perselisihan Pemutusan hubungan kerja adalah perselisihan yang timbul sebagai akibat tidak adanya kesesuaian pendapat mengenai pengakhiran hubungan kerja yang dilakukan oleh salah satu pihak. Pemutusan hubungan kerja (PHK), tidak saja diatur dalam UU Nomor 2 Tahun 2004, akan tetapi juga dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan telah diatur secara jelas mulai dari Pasal 150 sampai dengan 172. Perselisihan pemutusan hubungan kerja tersebut masih saja banyak terjadi hingga sampai ke Pengadilan Hubungan Industrial, padahal upaya pencegahan dan atau penyelesaian masih banyak jalan yang dibenarkan oleh UU dapat ditempuh (non ligitasi) sehingga tidak semua perselisihan pemutusan hubungan kerja bermuara dan diselesaikan di Pengadilan Hubungan Industrial. penyelesaian perselisihan pemutusan hubungan kerja dapat ditempuh melalui, yang pertama melalui Lembaga Kerjasama (LKS) Bipartit, lembaga mediasi, konsiliasi dan arbitrase. Sehingga dengan demikian penyelesaian setiap perselisihan hubungan industrial dapat diselesaikan cepat, tepat dan biaya murah serta tidak memerlukan waktu yang relatif lama.
