Tanggungjawab Notaris Terhadap Pembuatan Perubahan Atau Pencabutan Perjanjian Perkawinan

Abstract
The marriage agreement is an agreement agreed upon by the prospective husband and wife before or at the time of marriage to determine the legal consequences of marriage on their treasure, under certain circumstances, it is also possible for a married couple to make changes and even revocation of the Marriage Agreement that has been made as long as it is in accordance with the law. This article encourages the notary to be carefully in making the deed of amendment or revocation of the Marriage Agreement so that the notary can protect the interests of the third parties involved and to avoid all claims and lawsuits that may be filed by third parties if someone is harmed, because if the deed made by a notary is detrimental to third parties, then the deed will be null and void.

Abstrak
Perjanjian Perkawinan merupakan perjanjian yang disepakati oleh calon suami isteri sebelum atau pada saat perkawinan untuk menentukan akibat hukum perkawinan terhadap harta benda milik mereka, dalam keadaan tertentu maka pasangan suami isteri juga dimungkinkan untuk melakukan perubahan dan bahkan pencabutan Perjanjian Perkawinan yang telah dibuatnya selama telah sesuai dengan ketentuan Undang-Undang. Artikel ini mendorong agar notaris melakukan secara saksama dalam pembuatan akta perubahan atau pencabutan Perjanjian Perkawinan agar notaris dapat melindungi kepentingan pihak ketiga yang terkait serta agar terhindar dari segala tuntutan dan gugatan yang mungkin diajukan oleh pihak ketiga apabila ada yang dirugikan, karena apabila akta yang dibuat oleh notaris merugikan bagi pihak ketiga maka akta tersebut akan batal demi hukum.
